Legal Ramifications in Asante Hospital Drug Diversion Case:
A Personal Injury Firm’s Perspective
Idiart Law Group is saddened to learn about the lives lost and altered due to the negligence of a nurse at Asante Rogue Regional Medical Center and stands ready to help the patients and their families get justice for the injustice done on them and the impact that it will have on many lives.
An investigation is underway at Asante Rogue Regional Medical Center in Medford, Oregon, following allegations of fatal infections caused by the misuse of opioids. Multiple sources, including NBC5 and the Rogue Valley Times, report that as many as ten patients may have died after a nurse in the Intensive Care Unit allegedly substituted the opioid painkiller fentanyl with tap water, with several others being severely injured. This substitution is suspected to have led to Pseudomonas infections, a type of infection that can be contracted in healthcare settings from contaminated water or soil, particularly affecting patients with devices such as catheters or those on breathing machines.
Dr. Robin Miller, host of NBC’s Docs on Call, explained that such non-sterile tap water could cause severe infections, potentially leading to sepsis, pneumonia, and organ infections. This practice of replacing drugs with other substances, known as drug diversion, is not unique to the Rogue Valley, with similar incidents reported in Boston, New Hampshire, Wisconsin, and Montana.
The Center for Disease Control (CDC) notes that Pseudomonas can be a serious threat, especially to certain vulnerable patient groups. So far, no one has been charged in connection with the Asante case, but the Medford Police Department, under Lt. Geoff Kirkpatrick, is investigating these reports.
Asante, in a statement, expressed distress over the issue and confirmed their cooperation with law enforcement. The reports have also impacted residents of Grants Pass and Klamath Falls, who were notified of family members’ deaths linked to these infections. The investigation continues, with more details awaited from the authorities involved.
In light of the recent allegations at Asante Rogue Regional Medical Center, it’s important to consider the legal implications. If hospital staff such as nurses or physicians are found to be diverting drugs, they could face state board investigations or malpractice lawsuits. Moreover, the hospital itself may be legally vulnerable, especially if it was aware of such activities and failed to act, or if its internal procedures should have alerted it to these issues.
Hospitals often claim they acted promptly upon discovery of such incidents, but this doesn’t address whether their policies and procedures should have alerted them sooner.
