How do you successfully appeal Social Security disability?
When it comes to Social Security Disability, there are no guarantees, but there are ways to position yourself for the most favorable outcome on your claim. Social Security has made it increasingly more difficult to get approved for benefits, due to this you must have a clear understanding of their timelines to appeal and provide evidence, as well as what medical evidence is needed to support your medical condition. What are the chances of winning a Social Security appeal?
Social Security’s approval rate has been slowly decreasing over the past 20 years and is now around 30%. The statistics show that having a representative on your case can dramatically increase your chances of getting a favorable decision. There are three different sets of criteria that Social Security evaluates medical conditions, understanding these rules and how your conditions fit within them will give you the strongest argument in winning your appeal.
How long does an appeal take?
If you have recently been denied at the initial claim level, the next step is to file a request for reconsideration. This level of appeal most commonly takes 6-8 months to receive a decision. If you are again denied, the next step is to request a hearing before an Administrative Law Judge. It can take 12-18 months to have your hearing scheduled and another one to two months to receive your decision from the judge. Making small mistakes in paperwork or missing deadlines and appointments can set your case back even further.
